Upcoming Foreclosures

California Foreclosure- Judeciary or no Judeciary? how to findout?

if the lender sends a notice of trustee's sale and nothing from any court. The lender buys the house in the public auction for far less than FMV. Does California law allow the lender to presue a deficiancy judgment since they bought it themselves instead of a third party bellow FMV? Received ONLY 1099A (WITH FMV HIGHER THAN BALANCE) but no 1099 C for the same year.. any help would be highly appreciated

  1. With a nonjudiciary foreclosure they can't come after you for a deficincy judgement.
