Under Florida law, if you go through foreclosure?

Can u get homestead ememption taken away from you on a future home. Can you lose your car, 401k, stocks? Please site your source. thanks

  1. As long as you declare your future home your domicile then you would qualify for homestead exemption. If your mortgagee (lender) is granted a deficiency judgment that would attach to anything you own. I believe 401K's are exempt. realtor.sailor
  2. It sounds like you are facing this situation and I hope you can find a solution that doesn't involve foreclosure. I don't think your future homestead exemption is at risk, nor is your car, etc. But realize that if your lender gets a deficiency judgment against you (after the foreclosure auction), it can then enforce the judgment against your various non-exempt assets. Best advice: talk to a lawyer and take advantage of the government resources available to you.
