Ca homeowner eviction process?

under California law Once a foreclosure begins and a stay is set due to a BK, then the BK is dismissed or discharged and the stay is released, how much time does a homeowner have in being forced out of the home? What is the process

  1. most give 30 days notice to move out. not sure of the other parts. my ex friend's family got their home forclosed and there was not much of a process. they got a letter and were out in 30 days. best wishes.
  2. The process of Foreclosure is fairly straight forward. Step one is the Notice of default...that is filed with the court house and appears in the paper. To total process takes 3 months and 3 weeks from the notice of Default filing to the Trustee's sale. There can be delays and you might pick up some extra time if the bank is swamped...and many are...At the Trustee's sales it is not uncommon to have them postponed for a variety of reasons. Shortest amount of time to be out- 3 months and 3 weeks! Maybe longer if you hold over after it is purchased or the bank takes it back...If the bank takes it back they hire an agent and then you are asked to leave...If you don't they can offer you what is called "Cash for Keys" they pay you to leave...If you don't take it they will start the legal process to get you out at that point.
  3. Move when the bank tells you or chance coming home one day and having your stuff piled on the curb, open to scavenging by passersby.
