Help understaning foreclosure law / process in Missouri?
I live in STL Mo and need help understanding foreclosure processes in Mo. I was told we had to be served by cert. letter 20 days before the sale date, we weren't. We just found out the house is being sold on courthouse steps on 6/10!!! We want to move but don't have enough time now. What is the process of foreclosure in Mo? We the sheriff put us on the street the day after the sale? Will we have to go to court where we can plead our case to the judge to just give us more time (we have 4 children)?? Any help or advice is appreciated ahead of time. We filed a ch. 13 to keep the house in Dec. 07. They hiked the payment in Feb. We spoke to our attys who said we would be served by cert letter of the sale date. We never received the letter, I only found out about the sale date through an advertisement. When I called our mortgage co. they said they didnt have to give us that time. So, we did not know the house was up for sale - they never served us with any papers. Never put anything on our door. All we need is another 30 days, is it possible to try to get that from the lender? Also, do they have to give you time to move out after the sale? I thought there would be a court date or something?? - on that letter they should have posted on your door regarding the auction of the home in June, there should be a phone # to call ...Yes if the home sells on 6/10 at auction the home will no longer be yours if it does not sell it will be the banks home and yes, you will have to move or they can have you removed. I cant beleieve you knew nothing until now. How many months are you behind? all this time your bank was not willing to work with you at all? they can do derferemnts or modifications where they would put those months that you owe on the back of the loan. I cannot understand why your bank wont help you. Can you Refinance NOW before it is to late? You need to do something very quickly ...Call the county in where you reside maybe they know of what you can do. - After the foreclosure sale, you are no longer the owner. The new owner will have to go to court to evict you. You will be notified and given a chance to appear in court. If you loose, the sheriff will evict you. How soon depends on how busy the courts and sheriff will.
