Upcoming Foreclosures

If house is situated on 2 parcels. Mortgage company made mistake and only put mortgage on 1, and I still own..

The 2nd parcel is still owned by me. I didn't want to lose the house, but my husband left and I couldn't afford the mortgage so they foreclosed on me. But, they can't sell the house because it is on both parcels and I still own one. What should I do? Do I have rights? They are acting like jerks at the bank, but I can't get a loan, obviously because of the foreclosure and divorce. I left the property like 3 years ago, and it is just sitting there. I have tried contacting the attorney in charge of the property, but she NEVER calls back and everyone else I spoke to in REO department, always seems to stop working there after I speak t them concerning it. But, the last person in that department that I could speak yo left last week, because they said the property is not in the REO department because it is still in litigation and not for sale. What do I do? I need my house back. Can I just go in there, or will the cops come get me? Also, they have had potential buyers, contact me and offer me $1000, for me to sign over my portion of the property. I have been paying rent for the last 3 years of almost $1000, so I wish they would just grant me to go back in and pay a mortgage to re-pay what I owe. Can they do that?

  1. Go in where? The bank? They won't talk to you and yes, the police will escort you out if you are a problem. You need to wait for the litigation process to complete. While you already lost the house, that one is done, they are likely going to have to either pay you for your lot, or get a lot line adjustment. Paying you is easiest, unless you do not cooperate, then they can get an adjustment or just tear the place down. You aren't getting the house back. It already foreclosed. That ship sailed.
  2. You don't own the house, and if you try to move back in, the police will remove you once this is discovered. The house is foreclosed, you don't own it or have any rights. When the lender gets around to it, they will take whatever legal action is necessary to correct the errors, then sell the house. No, the bank won't "grant" you a mortgage and let you move back in. Most lenders will not issue another loan on their foreclosure properties. What they are offering you is an incentive to just sign off the other parcel to avoid litigating this in the court system. You should take that deal rather than hang on to some false hope that some miracle is going to happen and you'll get the house back. It's been 3 years, move on.
