What are foreclosure laws and procedures in the state of Illinois? are all homes auctioned?

illinois foreclosure question bk7? my moms landlord filed for BK7 (sept 1). i always pay 3 months advance, i do not want my mom to get dupe as she lives on ss and my brother and i splits the rent. the landlord said the house will not be foreclosed for another 7 months. he also added that this is the minimum amount of time provided for him according to illinois law. how true is this? P.S. yes, i am already looking for a new place for my mom. i just want to know if my mom really has seven months. Thanks in advance

Foreclosure/Eviction Notice Questions? Our house is in foreclosure or has been foreclosed...not sure of specific term. We haven't received anything from the county giving us the auction date but we had the house on the market to try to do a short sale (no luck) & our realtor told us 7/17/08 was the date. It was also listed in the paper. We talked to a lawyer who stated in our county auctions are only held Tuesdays & Wednesdays so the auction would have been held 7/22 or 7/23. We still haven't received anything & today is the 23rd. We live in Illinois were the law states we have 30 days from the auction date to be out of the house. We already have a rental & are moving the weekend of 8/1. My question is, when & how will we get the eviction notice? Because we're moving, do we lock up the house & leave the keys inside? Also, I was told by the lawyer that if we will be served with a deficiency notice we'll know pretty much right away. Is this true? I don't want to be surprised a year from now! Thanks for your help We got a letter today from the lenders lawyers. They must have pushed it back a month cause now the auction date isn't until mid Aug. and it states we have 30 days from that date to move and gives us a number to call if we will be moving before that date. So I guess I have my answer on this issue aside from the possible deficiency judgement, but we can talk to the law firm when we call to let them know we're out. Thanks for your help.

If you sign a lease and later find out that the house is being foreclosed on will you get your money back? I just signed a lease in February for March 1, 2009 and the lease doesn't end until August. The person who rented the house to me stated that he was the owner, he'd let us rent for 2 years at the intial rent, that he wouldn't put the house on the market for 2 years. We just found out on April 4, 2009 by the realitor that came to our house that he's not the owner, just manages the property, and the house is going into foreclosure. Is he legally required to return all the money given to him? I heard in the state of Illinois there was a recent law passed protecting renters in this kind of situation.

Now before all you liberal demophytes who are incapable of research jump on this issue remember that Dems were talking about how stable the credit markets, particularly Fannie May and Freddie Mac were. Dems blocked any other legislation. McCain voted for the Bankruptcy law and Obama voted against it, do your own research for those links. My preliminary assessment is that essentially the changes in Bankruptcy laws were meant to stabilize the credit markets, but, what they did was encourage predatory credit companies to further target people with subprime mortgages. In my opinion the extended credit and changes in bankruptcy laws are secondary causes to the current crisis. Too much credit and reduced ability to structure debt forced people into mortgage foreclosure which caused the crash. FYI, it looks like 40% of the recipients of these predatory lending practices were new (illiterate)college grads. You know, the Obama supporters. Is the foreclosure law in Mo.different than in Illinois in relation to being behind on 2nd, Current on 1st.? We're 2 months behind on our 2nd. Homecomings Financial (holders of the 2nd) told us we had to fall behind 2 months before they would even talk with us about loss mitigation. Now that we are behind they seem unwilling to talk with us about any hardship options. How long does the typical foreclosure process take? Are we talking a month or a few months?
