Texas Foreclosure? I am in forecosure and the house was sold on July 1, I just now got a flyer looking notice that I have 72 hours to contact the new owner or they will rekey the house. Is this a legal document? I have not recieved a eviction notice. I have been told it is a scare tactic. can I please get advice from someone who knows the laws or been through this? bankruptcy to save foreclosure in corpus christi,tx? i am going to see a lawyer to try to stop my foreclosure tomorrow . my end date is july 3,2007. if i have loans that i am not the primary account holder do i need to take those to show the lawyer as well or do they not count to file. if by any chance i get a petition from the lawyer to the court by the end of day tomorrow will it stop the sale of my property the next day. people in my city are waiting for my house to forfeit. that sucks because i put alot of money to it. i am trying to sell the property to make a profit and bankruptcy is my last resort to pocket something. if i read correctly texas law states the courts can only take profit money only if i exceed over 15,000.00 in profit to satifsy my lenders . is this true... please help tomorrow will be a long day of ass kissing
certified bank letter for home foreclosure? I have a home in Texas and I received a certified letter form the bank which has been returned because we did not know it was there. How long by law do I have to get my stuff out?
Contract Law Question: Can creditor who verbally agreed to payment over time change to demand payment in full? The creditor is a Condominium Association led by an aggressive President who fooled Co-Owners into believing they all needed an expensive new roof when only limited repairs were needed. When Co-Owners were misled into approving it, the President demanded payment in full but allowed one Co-Owner to pay over time. In this, the President / Condo Association became a creditor and had a verbal contract with the Co-Owner for time payments. Time payments were made and the President cashed the first 3 checks from the Co-Owner. Then realizing they needed money now, the President demanded payment in full from the Co-Owner and threatens to put a lien on the Co-Owner's condo and possibly force them into bankruptcy or foreclosure if payment in full is not made. The Co-Owner obliged by all terms of the verbal contract but when the President changed her mind on the payment terms, she rejected all subsequent installment checks. There is first the case of Fraud by the President to fool Co-Owners into a vote for a roof they didn't need (and evidence that the President had a kick-back deal with the roofer to profit from awarding them the exclusive, insider's contract.) But that is not what this question asks. This question asks: 1. Is not the verbal contract to accept payments over time BINDING on the President / Condo Association by virtue of the President cashing (signifying ACCEPTANCE of terms) the first few installment checks? 2. By rejecting installment checks after the first few, does this constitute DEBT FORGIVENESS such that the Co-Owner does not owe that money anymore? 3. As this is in the state of Texas where Homestead laws apply, are there any special limitations which would declare the President's actions to file a lien on the Co-Owner's condo (their only residence) and threaten foreclosure as either illegal or unenforceable? 4. By virtue of the fact that this verbal contract for time payments came about as a result of the President's fraud giving rise to the Co-Owner's debt to the Condo Association, could the contract itself be declared VOID or VOIDABLE? And if so, does not the fraud have to be proven first before the verbal contract be declared void or voidable? Note that there appears to be no default by the Co-Owner under the terms of the verbal contract which might justify the President / Condo Association accelerating payments to demand payment in full now. The deal the President made was a bad one and not to the Condo Association's benefit, but it is a verbal contract and may be binding. Furthermore, there was no discussion of INTEREST to be paid by the Co-Owner for installment payments. 5. Home Owners Association - I bought a foreclosure - nothing I signed refers to HOA - am I obligated to Pay 500? Just bought my first house. It was a foreclosure & due to a transferring stock issue and a contractual time restriction, my mom stepped up and wrote a check for the house and then sold it to me in a completely second closing as if I were a complete stranger with escrow and all. No where in her ( moms ) purchase or in my second closing paperwork does it say anything about obligating me or her to pay HOA dues. * As far as I know they don't provide any services other than the community swimming pool which is of no value to me. * The other reason I don't want to sign the contract they are harassing me to sign and submit with 500 dollars is then they think they can boss me around with their "nazi rules" like no garden in "my back yard," or some kind of building restrictions, etc... So my question is this: * Isn't this an issue of contract law ? I didn't sign any contract or anything of any kind referring to or promising in any way any payments or participation to any HOA. * So Am I Obligated ? ( San Antonio, Texas ) * Seems like if I don't sign anything they have no power over me ? ? ? Thank You...
How do I get renters out of my house that will go into foreclosure 1/1/10 because they didn't pay Nov/Dec, yet? They owe: November December January (due on 1/1/10 and if they don't pay it will go into foreclosure that day) Am I in any trouble? Believe it or not, they are Patent Attorneys and know the law pretty well. I'm just a homeowner that moved out to save the house and picked these losers to keep the payments up. I sold my car to pay my rent and bills here in CA. I guess they don't want to "suffer". ADVICE: Stay out of Texas. We've had nothing but troubles out there. We're finally home in CA again!

Foreclosure Eviction, Military Service Affidavit? My question involves real estate located in the State of: TEXAS The house my husband and I are renting was recently foreclosed. There are a lot of things that I feel hurt the Plaintiffs case, such as we have been in contact with 2 different law firms one of which told us we had 60 days to be out before we would be evicted also we never received a notice to vacate or any written notice. I believe they notified the homeowner but we were renting through a property management company and we were never informed verbally or written that we needed to move until we received a notice saying we needed to appear in court. It has been less than 30 days since the house was foreclosed and we received a Petition for Forcible Detainer and with it was a Military Service Affidavit stating that the named defendant is not active duty signed and notatrized but my husband IS active duty military. Will this error in their paperwork effect the case? I used to be a property manager for apartments in FL and AK and with our evictions if we had an error in our paperwork we had to re-file everything or the case would be thrown out. I do not know if this is the same in this situation or in Texas. I sincerely appreciate any advice.

Many people are finding themselves in the circumstance described in the article..... bought a home when economy was good, economy tanks, home prices dive, lost jobs, foreclosure.... So can the bank hit you up directly for these enormous sums of money, even though the short sale or forelosure couldn't be done without the banks approval ? The answer is.... Depends on where you live. See ...those red state voters often side with the bank, and they elect politicians who are corporate minded people, good ol' supply side boys... they don't usually side with the consumer. This is the reason that those are the states where the banks can wait up to five years...potentially increasing the loss to you on purpose, before they file a judgement against you. I believe if you take out a loan, you should pay that loan off. You agreed to pay, you should pay. However... I also feel that the responsiblity for this "investment" should not just be on the consumer in the event that the value of that investment plummets. The bank made the loan with the intention of making money, but that profit intention is no more guaranteed than the equitability of that investement made jointly with the consumer. Additionally, there should not be a legal instrument, in which the lender can legally delay filing a judgement, for the purpose of increasing their claim. It would appear that practice is yet another practice, where the bank is taking advantage of the consumer, by placing all of the potential future losses of that property investement on consumer. James... the lenders made bad loans on of their own free will...because they thought home prices would go up forever...so even if the consumer defaulted, they would have positive equity in the home itself allowing them to recoup the loan and still make a profit.... Can I avoid forecloser? I bought a home four years ago through owner financing, also called seller financing. I have fallen behind five or six payments but now owe only two payments of $510. I can make the last two payments this month; however, the seller has notified me by mail that he is "accelerating" the note, and the case is to go to court on June 2. My question is, can I simply make the last two payments, which will make me current, and avoid foreclosure. I'd hate to lose the house, even though we moved into another home last August. I'd hate to lose all the equity in the first home. I'd also hate to have the foreclosure appear on my credit report. Is there anyway out of this mess? I live in south texas and texas laws apply but I don't know where to look online to see if I have any rights.

Judge refuses to hear cases? A friend with a disabled child was in court 2 weeks ago for personal property. Texas Land Board issued a clear title/deed to ex-father-in-law after his son defaulted on loan. The loan was paid off before actual time of foreclosure, and loan was in son's name at the time. She was trying to get her fair share of property, but was having to fight both ex and ex father-in-law (he has money, she doesn't). Judge refused to hear all cases that day, made all cases go to back and "settle it". Now she has lost the property valued at $85,000.00 and had to have all personal property removed and out by last Friday at midnight. 2 questions: How can Land Board issue a clear title to property to someone who sold property to son WHILE IT WAS ALREADY IN A COURT BATTLE, and what gives any judge the right to refuse to hear cases? Her son has been disabled since the age of 13 months, and was not expected to live past 5 years old. He is now 16 and completely dependent upon her. The father and mother divorced about 5 years ago. The house was court ordered to her until the disabled child turns 18, which is on the original divorce papers. Which is why she is now having the problems that she is having. FYI, due to the nature of the disability of the child, she cannot work. He relies totally on her for all of his care, he is tube fed, and has been on hospice for about 6 months now. If she were to go to work and make any money at all, SSI would stop and she would have no income at all versus SSI and sporadic child support payments. All of this has made me realize that some people, lawyers, judges, grandparents, and this father care more about money than the safety and well-being of this child.
Can I get a $50,000 loan for a property that is selling for $35,000 but appraised and worth $55,000? I have been pre-approved for an FHA loan however my lender does not issue loans for anything below $50,000. The townhome that I am purchasing is a foreclosure so they are selling it cheap for $35,000 however according to tax appraisals the townhome is worth $55,000. My lender has a maximum 96.5 LTV (whatever that means) What I would like to do is get the $50,000 loan since they will not lend me anything less than that and use the extra money to repair the townhome. Defying veto threats, the House voted to let the Federal Housing Administration take on up to $300 billion in new mortgages so that financially strapped borrowers facing foreclosure could refinance. How would I go about renting my house out? Okay, so I'm only 22 years old, and my husband and I bought our home 2 years ago. Well, we are wanting to buy something a little newer and on a better side of town, so we have been making plans to sell our house and buy another one. Well, I started thinking about maybe renting the house out. I was just curious as to how I would go about doing that? Such as what are some laws I would need to know about, or do I need to have a permit to rent out my house? WHO'S TO BLAME FOR THE FINANCIAL MELTDOWN? People keep arguing over who's to blame, Republicans or Democrats? So I did some research on it all: The Glass-Steagall Act was created in the 1930’s to prevent the Great Depression from ever happening again by separating regular banks (retail banks) from investment institutions by a “firewall” and illegalized credit-swaps which had created the massive losses by investment firms caught in the Crash (because they were like unregulated gambling side-bet “insurance claims” which had no guarantees of money to back them up). So the Glass-Steagall Act kept Wallstreet risks from harming and affecting regular banks (retail banks), and kept Wallstreet protected from the massive losses of gambling with credit-swaps. What Happened? Bills to repeal the 1933 Glass-Steagall Act were introduced to the U.S. Senate by Phil Gramm (R-Texas) and in the U.S. House of Representatives by Jim Leach (R-Iowa). The bills were >opposed by the majority of Democrats<, but after some re-writing were passed as the Gramm-Leach-Bliley Act signed by Bill Clinton. This act tore down Glass-Steagall’s firewall of protection between investment firms and regular banks, allowing their systems to reintegrate. Who’s To Blame? So all the firms tangled up with them suddenly got caught either paying out of pocket to investors or losing the money they bought them with. Home Owners Association - I bought a foreclosure - nothing I signed refers to HOA - am I obligated to Pay 500? Just bought my first house. It was a foreclosure & due to a transferring stock issue and a contractual time restriction, my mom stepped up and wrote a check for the house and then sold it to me in a completely second closing as if I were a complete stranger with escrow and all. No where in her ( moms ) purchase or in my second closing paperwork does it say anything about obligating me or her to pay HOA dues. * As far as I know they don't provide any services other than the community swimming pool which is of no value to me. * The other reason I don't want to sign the contract they are harassing me to sign and submit with 500 dollars is then they think they can boss me around with their "nazi rules" like no garden in "my back yard," or some kind of building restrictions, etc... So my question is this: * Isn't this an issue of contract law ? I didn't sign any contract or anything of any kind referring to or promising in any way any payments or participation to any HOA. * So Am I Obligated ? People lost their homes and investments everywhere.... Some people aren't aware that even after foreclosure, giving it back to the bank, or short selling your home... you could still be on the hook for thousands of dollars of deficiency on your homes value. Many people are finding themselves in the circumstance described in the article..... bought a home when economy was good, economy tanks, home prices dive, lost jobs, foreclosure.... So can the bank hit you up directly for these enormous sums of money, even though the short sale or forelosure couldn't be done without the banks approval ? The answer is.... Depends on where you live. See ...those red state voters often side with the bank, and they elect politicians who are corporate minded people, good ol' supply side boys... they don't usually side with the consumer. This is the reason that those are the states where the banks can wait up to five years...potentially increasing the loss to you on purpose, before they file a judgement against you. So even though we were all affected by this.... did red state's voters get what they deserve, for electing politicians who side with the banks before the people ? I believe if you take out a loan, you should pay that loan off. You agreed to pay, you should pay. However... I also feel that the responsiblity for this "investment" should not just be on the consumer in the event that the value of that investment plummets. The bank made the loan with the intention of making money, but that profit intention is no more guaranteed than the equitability of that investement made jointly with the consumer. Additionally, there should not be a legal instrument, in which the lender can legally delay filing a judgement, for the purpose of increasing their claim. It would appear that practice is yet another practice, where the bank is taking advantage of the consumer, by placing all of the potential future losses of that property investement on consumer. What's worse is that they are doing these things using money that isn't even technically theirs. It's OURS. Using Peter, to kill Paul. Texas Contract for Sale and slow payors? A family member has several mobile homes which were sold on a contract for sale/installment agreement and most of the occupants are slow to pay every month. Do the typical landlord/tenant laws apply here and can he send them a 3 day pay or quit notice? Or does this have to be handled like a foreclosure? Any pointers would be very much appreciated. What chance is there of peace in the Middle East when we are led by such a flawed man? When you look at the present administration and the number of conflicts which have flared up since they came to power can you honestly see a lasting peace emerge as long as they stay in power? Just look at the CV of our president. Is it one which inspires trust, or confidence.What chance do we or the world have of lasting peace when the most powerful country in the world is run by a man with this track record.? the bush legacy? EDUCATION AND EXPERIENCE: • LAW ENFORCEMENT: I was arrested in Kennebunkport, Maine, in 1976 for driving under the influence of alcohol. I pled guilty, paid a fine, and had my driver's license suspended for 30 days. My Texas driving record has been lost" and is not available. I invaded and occupied two countries at a continuing cost of over one billion dollars per week. I spent the U.S. surplus and effectively bankrupted the U.S. Treasury. I shattered the record for the largest annual deficit in U.S. history. I set an economic record for most private bankruptcies filed in any 12-month period. I set the all-time record for most foreclosures in a 12-month period.
