Where can I find good Real Estate Purchase Contract-? that is good for people in the investing and pre-foreclosure business in the state of Colorado, without paying an attorney an arm and a leg to draw it up? I've heard many horror stories of people using general contracts downlaoded from sites that do not conform to their own states general realestate law and foreclosure law. Anybody know?
Does anyone know if in Michigan a bank can come after personal assets after a foreclosure? I am considering foreclosing on a condo in Michigan. I paid $369K in 2005 and my it has been listed at $225K for over a year. I still owe about $280K. I now live in Colorado and have bought another house. The condo is sitting empty in Michigan and is costing me about $3000 per month. The right financial decision is to foreclose, but I have the cash to pay it off and I don't want the bank coming after me after foreclosure. I've heard that in some states, the bank has to file a different type of foreclosure in order to come after assets and banks don't do it because it's very expensive and time consuming. Does anyone know what Michigan foreclosure law dictates? Thanks.
I didnt find out till the day of the auction sale date on jan,14 2010 that my house was for sale.? The bank bought back my house at a foreclosure auction on jan 14, 2010. They didnt send me a letter or put a letter on my door telling me about the auction date. Everything that I have read tells me that the bank needed to tell about the sale date ahead of time. Im still in my house know. Still no word from the bank. What options do I have?I also lost my job. Should I get a lawyer? I long can I stay in the house? When will a eviction letter show up? Some people tell me that they will give me 30 days to move out once the letter shows up, some people tell me 24 hrs once the letter shows up. What is the law in denver, colorado? In the foreclosure law summary it states that the public trustees office must also mail at lease 21 days before the foreclosure sale date a letter letting the homeowner know about the sale date. This didnt happen. There was no notifcation about a jan 14 sale date.
Can a bank just kick me out of my house? My house was sold at a auction in denver,co on jan 14, 2010. I found out that the bank bought it at the foreclosure auction.Does the bank give you a eviction letter saying I have to be out in 30 days or do they just show up anytime and tell you to get out on that day? What will happen in the foreclosure? After? I am not looking for a lecture here just want some information on what will happen when my home goes into foreclosure. Don't judge me because you don't know my full circumstances. First off, the bank (BoA) wont do a forbearance, modification or the like, so after 15 months of draining our lives monetarily, we are going to have no choice but to go into foreclosure. Our home is in Colorado, which is a non-judicial and judicial state. I want to know what will happen during and after the process. Can they sue us for what they will not recover? House is about 40,000 below what is owed. In the loan paperwork there is a a verse on Foreclosure. Can someone explain what it means in regards of recovering their money after they foreclose. "If the Lender's interest in the Security Instrument is held by the Secretary and the Secretary requires immediate payment in full under Paragraph 9, the Secretary may invoke the nonjudicial power of sale provided in the Single Family Act to commence foreclosure and to sell the property as provided in the Act. Nothing in the preceding sentence shall deprive the Secretary of any rights otherwise available to a Lender under this paragraph or applicable law." Basically, does this mean they cannot do a judicial foreclosure and not sue us for the difference? We can handle the 1099 that we would get as a consequence, just not having to come up with $40,000. Please help without being rude and if you must be rude, at least offer an educated solution. Thank you. This isn't the original loan we bought the house with, this is the refinanced loan. We don't have a second on it though.

I got a demand for possession letter from my banks lawyer.? I also talked to the public trustees office and they said that the banks lawyer hasnt reqwested a confirmation of deed. Can they send me a demand for possession letter even though the deed is still in my name in denver,co? The bank bought the house from me at a foreclosure auction on jan 14 without letting me know they had set a auction date for jan 14. The banks lawyer told me there is a march 10 fed hearing date set. How can they do that when the house is still in my name. They have not reqwested a confirmation of deed. Should I also file a claim against the bank in small claims court in denver,co? Can someone let me know what I should do that knows what the colorado law is?
HELP! My house is up 4 foreclosure.. 2 many people contacting me-who can really help & who's out to get me? The end result: My house will 4 close/auction on 4/11/07. Had some money saved to live on, but still fell behind. WaMu said would work w/ me but that was a joke. I want to keep my house, not sell. Have new job, (comm sales) will be making $$ but takes awhile. (From 02/26 - now, have made 3k. but payday is 3/24). Have only $1,800 left in savings. WaMu is f'ng around, losing paperwork etc., "law & Assoc llc" seems best to help, but I ? neg comments on posts. I pay $1,980 - they save my house. Redemption periods after auctions.? Have been looking at online ebooks to get educated about buying at foreclosure auctions, but struggle with some of the State law differences. I live in Colorado. Can some one tell me in plain english the basic difference judicial vs non judicial, what the redemption period means to the winning bidder, and does the original owner get a chance to redeem his property? Although I can't see how he could under the circumstances.

Chapter 7 Bankruptcy laws? I filed chapter 7 in 10/16/2005 and included my mobile. The debt was discharged in January 2006 and I did not reaffirm the mobile home debt. I have scheduled automatic payments with lender but still not current. Today, they contacted me about delinquent property taxes from 2007 that were sold at a tax lien. They want to pay the tax and bill me over 10 months for the taxes paid. I am concerned they are paying the property taxes to be able to apply for a permit from the county to move the mobile home. Can they do this without petitioning the courts where I filed bankruptcy? Am I protected under the Homestead act in Colorado and they must begin "foreclosure" proceedings?
Can we expect adequate disclosure from a seller in preforeclosure? We are home owners in Colorado looking at foreclosure opportunities for a home in Florida. With a preference for avoiding "as is" risk, we are checking out preforeclosure houses/townhouses near Fort Lauderdale. Apart from the Appraiser's report, and a Home Inspection report, can we reasonably expect adequate disclosure from a (presumably) reluctance seller? Is there anything in Florida State law which gives us that little extra protection? Does anyone have any ideas about the type of "serious defects" that wouldn't necessarily come up in the specialist reports?
