Is there a loophole for the new florida foreclosure law? I work as a loan modification specialist and my firm is a reputable company. We have a A+ rating with the Better Business Bureau and we really help our clients save their homes. Recently a statute passed that prevented companies from collecting upfront money from any home owner in florida that is in foreclosure for services related to saving their home. Of course no one works for free. Is there a way my company can get around this and collect our initial fee?

LAW PROFESSIONALS: What is the law in Florida regarding foreclosure? Once your home is officially in foreclosure do you have 90 or 120 days to vacate the premises? I've typically heard 90, but someone told me that in Florida you get 120 days before you have to be out. Also, what exactly happens if you just "walk away" like many people are doing these days? I know your credit is obviously negatively affected for many years, but are you at all responsible for any payment on the loan? And if you have HOA fees, will you be responsible for those once you go into foreclosure? This property is located in Miami. Dade County. Also, the property has not had the mortgage paid for 10 months. The lender is U.S. Bank. The foreclosure process is supposed to proceed as of 7/27/10. Papers have been sent in an attempt to renegotiate the loan, however, they have everything they need, but are still working on the file. It's not a matter of "stealing" the bank's money. It's a matter of trying to work with them and getting the response "We can't help you until you default on your loan." The property value is half of what it was when it was bought, and you're awfully high and mighty to make a comment like that during this housing crisis.

Florida Real Estate Lease Laws on Foreclosure? We are renters in Florida and we heard that our condo (leased through a private party) may be foreclosed. We don't have a clause in our lease on this issue. I've heard rumors of renters just being kicked out because of foreclosure and I've had legal advice saying the bank has to let you fullfill your lease by law until the end. Does anyone know the laws on this? We can't break our lease without having the pay the rest of our months rent but I don't want to get taken down with them. Thanks

In our apartment complex the late fee for an HOA dues is $50 when by Florida law they can only charge $25. The? my apartment makes money off of scared of foreclosure owners. Need advice!

How long does a foreclosure take in Florida? I am renting a house from people that have not paid their mortgage since September. I check the court records and no papers have been filed by the mortgage company. Today, a courier stopped by and delivered a note just asking us to call the mortgage company. I called and they would not give me any information because of privacy laws. I think I made a mistake in calling them, and now I'm a little nervous. Does anyone have any knowledge of long it can take to foreclose after the papers actually get filed?

How can I find out what assets are exempt from collections/judgments under Florida law? Hello, I have been googling and hunting all over the internet and am coming up empty handed. If anyone knows a web site where I can find out what assets are exempt from collections under Florida law, I'd appreciate knowing where to find that info. Please note this is not a bankruptcy question. I had a Ch. 7 bankruptcy six years ago and I can't do another one for at least two more years. In the meantime I have a lot of house-related credit card debt that I can't handle. I am already in pre-foreclosure and I am thinking of just letting the credit cards go. I do not want to file a Chapter 13 and have to be accountable to a trustee for every penny that goes in and out of my life for the next five years either.... I realize that if I let the credit cards go, I will probably get sued and have one or more judgments against me. I have five credit cards, total of $17k in debt, and one of the balances alone is $6k. I did find out that according to Florida law, because I am the head of household, I am exempt from getting my wages garnished. The only assets I'm worried about protecting are my eight year old Honda, and my bank account. I don't have any money in the bank account other than paychecks that go in and out. As I mentioned, I've been searching on the internet and can't find anything. I really need to know if I get sued by a credit card company, and if a judgment is made against me, if they would be able to seize my car and/or my bank account. Foreclosure happening in Florida - when do they have to leave? Friend's home has been in foreclosure in Florida for about 17 months. 31 days ago a Motion for Final Summary Judgment was filed - wherein I know this means the Order can be entered at anytime. How long do they legally have to get out of the house after the order? I would say now but they don't believe me. What will happen if they don't leave soon - the law knocking on their door? Tried to google this to no avail. Is it normal that they would set up the sale/auction date in the Order for Final Summary Judgment or does that come later?

When someone is in foreclosure, do they have the right to take what they put into the house that is attached? I studied real estate law a while ago so I am sure that a person does not have that right.  My boyfriend (who seems to think he knows everything about everything) says that a person does have that right. He claims that if someone puts up a fence after they take a lone out on a house, that person has the right to take down that fence when they are forced out due to foreclosure. Home Owners Fees in Florida? I am interested in buying properties at foreclosure auctions in the county of Duval (Jacksonville, Fl.). If applicable, under Florida law am I as the new owner of a property foreclosed via the court on behalf of the superior lien holder (the bank) responsible for paying "backpay" to the home owner's associations? Most of the paperwork for the notice to the sales state that once the certificate of title has been issued that all defendants (including the home owner's associations) will be foreclosed of claims. Can the Home Owner's association put in an entirely new lien on the property for overdue fees from a previous owner up until the day that I took possession?

I was told (correct me if I am wrong) that under "Homestead" a bancruptcy would let you keep your house. If this is true, and you're credit will be shot either way, why not try to keep the house?

how does one find out when a bank bought their existing mortgage loan since the bank is not the originator? Deustche bank is seeking foreclosure and they were not the ones who owned the loan. It's against Florida law to buy a loan when it is in default. Help anyone. many loans are not with the originator but that was not my question. I read that it is against the law to purchase a loan after it is in default. I needed to know how I can find out WHEN they bought the loan. Isn't public record?

In South Florida, can I be evicted from my rental unit if my landlord has not paid his HOA fees? I live in Fort Lauderdale. My landlord has not paid his HOA fees for 15 months now. The Property Manager wants me, the tenant, to pay the monthly HOA fees or says he will evict me. He claims that Florida Law allows him to do so. Is this true? If so, can I deduct from my rent the HOA fees and send two checks every month (one to the Property Manager and another to the Landlord) without the landlord approving? More information: The property is currently going to foreclosure. I am now on a month to month lease since my 12 month lease expired and we agreed with the landlord (by email) to continue on a month to month lease. I have always paid my rent on time. Can we expect adequate disclosure from a seller in preforeclosure? We are home owners in Colorado looking at foreclosure opportunities for a home in Florida. With a preference for avoiding "as is" risk, we are checking out preforeclosure houses/townhouses near Fort Lauderdale. Apart from the Appraiser's report, and a Home Inspection report, can we reasonably expect adequate disclosure from a (presumably) reluctance seller? Is there anything in Florida State law which gives us that little extra protection? Does anyone have any ideas about the type of "serious defects" that wouldn't necessarily come up in the specialist reports?

If I am renting a house, can the bank force me out if the landlord is going through the foreclosure process? Will the bank take my rent check? Are they required to give me any notice. I live in central Florida, just in case state laws apply differently.

My cousin, who lives in Florida told me that it is a homestead state.? She informed me that the banks could not take her house because of the homestead laws. Yet recently I saw statistics of foreclosures in Florida. And they were in the double digit range. Home in foreclosure bank changed locks? My home has been in foreclosure for about a year now. I moved out about 8 months ago. The foreclosure hasn't gone through yet so I still am the deed holder. The problem is the banks changed the locks and I still have a few personal things inside. I know I should have gotten them out a long time ago but I didn't. I can get inside the house through an unlocked window in the backyard. My question is am I legally entitled to do that? I live in Florida if that matters. Please only answer if you know the law. Redemption law? Does anyone know about a 10 or 14 day redemption law in Florida whereas someone purchases your home while in foreclosure and you are still residing there? I would really appreciate any reading material or advice.

My HOA in Florida just file Bankruptcy for $3000 debt I have with them. Will I loose my Condo because of this? Back in November of 06 I missed 2 HOA payments because of financial distress. However I was able to make up these payments minus the $150 late charges that had been tacked on. Unfortunately I was never able to make up that $150 late fees, and although I was never late again on my regular HOA payment over the course of the year my late fees ballooned up to over $1k. I have tried to work things out with my HOA, but they insisted I need to pay all late fees at once to become current, which as I stated earlier I am unable to do. Since this time my HOA has acquired the services of a law firm to to retrieve the debt, and because of doing so my total fee is over $3000, and I now find myself in foreclosure. I am current on my Mortgage,a nd have been current for almost 2 years on my HOA (not including the late fees). I have a foreclosure date in a few weeks because of this, my question is can they take my home although they are not the primary lien holder, or does this just mean they will place a lien against my home in the amount that is owed, but I am allowed to stay in my home.. What are the Laws in Florida as it pertains to HOA's filing foreclosure. Please help...

Is it illegal for landlord to rent a property that is in foreclosure? I live in Florida, and I'd like to rent a townhome, but I found out there is a Lis Pendes on it. I asked the realtor about it, and she says the house is not in foreclosure. She also said the owner is willing to sign an affidavit saying that the house is not in foreclosure. I already signed a contract to lease, but now that I know about the Lien, I am worried that if I move into this house I'd have to move out again soon, in case it does go into foreclosure. Is there a law that says it is illegal to rent a property that is in foreclosure? If I do get an affidavit from the owner, would I be protected in any way?

Real Estate Appraiser - Verify Repairs? This is not a new construction nor a FHA-insured loan. I am trying to purchase a foreclosure in Florida and my bank required repairs made that were noted on a home inspection report. I had 5 licensed contractors come in and do the required repairs (electrical, AC, windows and doors, etc.) ... all minor, maintenance, per the contractors (none noted that any impaired the safety, sanitation or structural soundness of the dwelling). I even had an architect look for structural integrity issues for my own peace of mind (architect opinion allowed under Florida Law). I had each licensed contractor sign the home inspection report next to each repair that applied to them and I have their itemized bills / invoices which state repairs made per inspection report or inspector. Last week the appraiser came out to the property without anyone's knowledge; and therefore, did not go over the inspection report. He said he would only look at what he noted on his original appraisal (items which were not required to be repaired by the bank). The bank order the appraiser again to came back to the house and again specifically order the re-inspection according to the home inspection report. Now another week has gone by. Time is of the essence and I am paying 100.00 per day to the seller for this delay up until the day of closing because I have asked for 3 extensions, so far it has cost me 700.00 for this delay and will cost me another 1,400.00. I also had to sign an extension including that my 2,000 earnest money is now be non-refundable. If do not close in 1 week, I will lose the house and the money I have paid for the repairs (all contractors came in less than 24-hours notice and finished in 4 days). How is the appraiser to verify that the repairs have been done? He will do a walk-through I assume. Some things are visual, but others are not. Can he use my copy of the home inspection report signed off by the contractors and their itemized invoices? Crazy, I know. But the banks are making it extremely had to purchase a REO / Foreclosure. I know you are saying, just get another house. I really want this house, I am getting it for a great price and it is a great investment. I looked at 22 other houses and this one is in great condition for a foreclosure. I agreed to do the repairs because I would have done them anyway. Besides I was 6 weeks into the deal when the bank made the demand for the repairs. This appraiser took 3 weeks to come out and do the first initial appraisal. And I do now have an attorney to file suit if I do not close. This is in part "the principal" ... big banks beating up the hard working little girl or guy. Does foreclosure mean they can take other properties from you?? My mother-in-law owns 2 houses in southern Florida…the main one she lives in and the investment one she bought several towns over 2 years ago. The second one that she owns and had been renting out is now empty and she can no longer afford the payments. She has been to see her mortgage bank and they told her that it is only after she is 60 days late on payments they have to “do something about the situation.” We have been talking and talking for days now and she has decided that the only viable road left open to her is a Foreclosure. She has asked me for information about it and I do not know about Foreclosures. Does anyone know if her main house – the one she lives in and maintains a Homestead exemption on – can be taken from her if she Forecloses on the second one? HOW DO YOU REMOVE A FORECLOSURE OFF YOUR CREDIT? I am helping my sister in law fix her credit. but she has a foreclosure on her credit report. We live in Florida and this happened about 3 years ago. How can she remove it before the 7 years? Any advice or help Please! Well she was very responsible with paying her bills. Her son is autistic and she lost her job a year ago. What money she do have she spends on him. She is a genuine nice person, something bad just happened to her. Thats why I'm helping her. Foreclosure sale question? I just got back from new years family get together and found an advertisement letter from a law firm saying my condo was up for foreclosure sale on 1/6/10. Aint I suppose to get an official notice from the lender or county saying this? I mean this letter basically states "The records at the county clerk show that LENDER is scheduled to sell the prop. on 1/6/10.....If I already have a lawyer to please disregard the letter...ADVERTISEMENT!!!! I was expecting some sort of official letter from the lender saying when my last day would be, but I haven't received anything of that sort. I checked the clerk's website (which took some research) and sure enough I'm one of the 100's being sold that day. Also, is it possible that no one would buy the property? This is one of many condos in the same complex facing foreclosure....if no one bids on it will I be able to stay in it longer? I figured talking to the lender would be pointless since I have no income what so ever to offer them...I've surpassed 1 year of unemployment and no more benefits....The condo has been in forclosure for two years, since they had lost the original note....The last "official" notice I received stated they found the note and were presenting it to the judge....that was 2 months ago....nothing official after that untill I received this lawyer advertisement in the mail today. Don't they give you 30 days to leave the place? BTW, this is in Florida. I know alot of questions, but any help would be much appreciated. Going crazy, but keeping my cool...Thank you in advance.

The mortgage was done without widow's knowledge? Individual died, but property was homesteaded and only on his name, marriage was more than 5 years old, married by law and in church, does it make any difference that property was homesteaded ? . His "Attorney" failed to probate within 3 months as required by Florida Law, it is now 9 months latter isn't it "Negligence"? Now a second mortgage shows up, but widow was never notified of missed payments and she is facing foreclosure. Is this fair?

HELP! the condo we're renting is in foreclosure!? we just got a notice from a law firm in the mail that the condo we live in is in foreclosure. our landlord has our last month's rent and security deposit and we don't want to lose them -- especially the security deposit. the real estate agent who got us the place says we should STOP PAYING RENT NOW, and also contact the landlord to ask for the deposit and last month's rent back and negotiate a lower rent until we leave. if they won't give the money back, she says we should stay at least 2 more months (the amount we've paid for with the security deposit). is this okay? is there anything else i should know? i don't want to end up losing money or out on the street with my kids, but i also don't want to ruin my credit or look like a bad tenant. thanks so much for your help, lisa in florida

How can I protect my family from my terrible sister-in-law? Long story short: my brother married THE most selfish, self-centered, childish, tantrum-ing, BRAT of a woman. my entire family does NOT like her, and she has dragged my brother through the mud in so many ways. the first time our family even heard about her was when my brother said "here's my girlfriend...she's pregnant", then got married a couples years later, had another baby, bought a new-construction house (which they couldn't afford), immediately after had to file for bankruptcy, borrowed THOUSANDS of dollars from my parents, then faced foreclosure, and moved into my parents house RENT FREE, with their 2 children, and decided it would be a good time to have a third child...while still living at my parent's house, and after my brother quit his job! not only has this been a financial strain on my parents, but their COMPLETE lack of appreciation or help has now caused severe health risks to my father. recently, he was diagnosed with cancer, and their house has become so incredibly FILTHY!! (if you've ever seen the show "how clean is your house?", THAT'S how bad it is!!) well, i've decided that since my dad's first surgery is in a few weeks, and my parents are going to visit my GOOD brother in Florida for a week, it would be a good time for us all to get together and clean the house for my dad while they're away. it's an EXTREMELY big job, and we definitely need all the help we can get! MY husband (who works 3 jobs, and has also battled cancer), is fully willing to help out, but my sister-in-law, is more concerned with relaxing on her "days off", than rolling up her sleeves, and helping make the house better for my dad. (and when i say filthy, i'm talking MOLD, and MILDEW, and a slew of bacteria and diseases EVERYWHERE). with every suggestion i make, my brother keeps throwing up road blocks to try to wriggle out of helping or doing any REAL work! this is something that NEEDS TO BE DONE for my dad, and the job is WAAAY TOO big for me and my husband to do alone, so how to i encourage them to help, without COMPLETELY bitching them out? (which is what i feel like doing.) i am scared to death that in my dad's fragile state, he'll come home from the hospital on the way to recovery, only to have complications because he caught something from their FILTHY house. tenants rights in forclosure? the home I rent is in foreclosure, I was served papers yesterday. I have asked the owner if I can use the $2000 security as the next two months rent and then pay monthly, he told me to speak to the agents who I pay the rent to. They say its against Florida law to do this and I have to pay the rent as normal. My lease runs out in August but I have been told that an auction date will be set for the house within 30 days. How do I get my deposit back and what happens if I refuse to pay til my deposit is paid back? Is the only way to get the deposit back, even if used in rent, to get the owner to cancel his contract with the rental agents?

I have a Ballon Short Term Promissory Note valued @ 42K and a 160K Note/monthly payments of 5k plus with a person living in France that bought my business in Florida, U.S. Currently, the buyer is 30 days past due, as of June 1, 2008 and refuse to acknowledge payment(s) or pay balance owed. The buyer has appointed her brother as power of attorney who is currently running the business, is listed as corp. pres. and living in Florida. The brother, also the broker, knowingly and willfully breached the contract agreement, thereby, causing default of payment and forcing me to seek legal action. It very difficult for me to find an attorney willing to sue a person overseas (France) and; as a single mother of three children, my funds are limited and home is in foreclosure due to the loss of income provide by the buyer. I have a Security Agreement on the assets in the business, however, I released all my corp. shares to the buyer, and in good-faith I would be paid. There is no evidence, at this time, which the buyer knows what her brother is doing; however, the brother is doing everything he can to discredit me (going as far as accusing me of stealing from him (?), untrue). My Security Agreement and Default Agreement states that if the buyer goes in default all assets can be seized or sold to satisfy the loan (money owed to me). How can I sue the buyer or the brother acting as power of attorney without appearing in France? How can I sue the buyer in the U.S and demand for her to come to the Florida to settle? And, how can I file a judgment to seize the assets (the fastest way for results) if the buyer lives in France? What can be done when 2 people own a home, one person lives there, is not paying the mortgage and will not ... agree to sell the house. They are in the middle of a divorce and rather than sell the house and split the cash 50/50 as required here in the state of Florida, the husband is forcing the house into foreclosure. In Florida can a landlord reestimate damages after a tenant has been out of the property for 4 months? I moved out of a rental house on 2/15/08 after a 1 year lease. In March the former landlord sent a detailed list of damages totalling $634 (I thought excessive, but didn't want to argue). I gave a deposit of $1875 when I moved in and never received the balance of my deposit in the allotted amount of time. I sent several letters requesting the balance of $1241 and he kept coming back asking for verfication of the money he was paid. I gave that to him (all written of course) and demanded a return of the balance before taking it further. It is now June 26 and today I received a check for $528.70. In the letter he states that the damages are more than what he originally stated. Can he do this? The time, by law has been up for quite some time. I feel like he is trying to keep the money because he doesn;t have it. By the way, the house is in foreclosure. Should I go after the rest of the money he owes me or just leave it go? Also, if I cash this check do I give up my rights to the rest?

Vacate a rental lease in Florida? I signed a rental contract starting July 1 - tried to turn on the water - was told the Bank owned the house - found out house was foreclosed and sold to the bank july 09 - title in the banks name - landlord and agent state there is a "modification in progress" which is why the home is in the banks name (lie) and by law I can still move in, the contract is still binding cause until the house is sold the owner can do what ever they want. went to the court house and pulled the file and yes the title has been granted to the bank. James... the lenders made bad loans on of their own free will...because they thought home prices would go up forever...so even if the consumer defaulted, they would have positive equity in the home itself allowing them to recoup the loan and still make a profit.... Bankruptcy and foreclosure? Ok I am asking this on behalf of someone else so i dont know much much about this. She owns a house(South Florida) which has lost about abput 40,000$ in value. She is looking to foreclose and then file for bankruptcy due to some laws made apparent by lawyers she will be able to get her house reappraised to the current value and can begin to pay for the house again without loosing it. But she is also going to win a lawsuit against a local company making around 20000$ as a re compensation. Here is were the questions comes in place. She was told that if she wins she must handover that amount of money which was won over to to the debtors and bank as payment leaving her no gain is this True? please give me a resource and if to little information was given do ask for more. also Provide details. Will an insurance company insure our home if there is a unpermitted cottage? I'm in the process of buying a foreclosure home (Florida,USA, can't transfer the insurance since it has already lapsed) that has a detached unpermitted cottage (2 bedrooms, kitchen, bathroom and living room total of 900 sq ft), the main home also has a unpermitted converted garage that is used as a in law quarter (separate entrance and full bathroom), it also has a unpermitted sun room too. I really love the home and tried looking for home insurance but it looks like no one will insure me. Is there anyway I can get insured for this property without having to lie about these unpermitted additions to the insurance company? Any advice would be appreciated and any suggestions which insurance company would insure me for a reasonable price. Thank you in advance.

All HOMEOWNERS forced to ....? remove, dismantle, tear down, etc., whatever EFFICIENCY, studio, in-law-quarters, etc. in their home (especially here in South Florida), by "supposed" city ordinances_which in reality there were none to begin with, and besides taxes were charged on these illegal additions up until someone 'tipped" authorities, and owners were made to tear them down. Now that these same homeowners_in some cities in the thousands, literally_have lost or will be losing their homes in foreclosure, shouldn't there be some type of legal recourse against, city, county, and even state in the form of a HUGE civil suit? City and Counties both were charging taxes (extremely high, which is one cause for foreclosure in S. Florida at present)> Wasn't it their duty, obligation, etc., to check over these properties once they were matched to the original records, tax cards, etc., and upon finding them w/ illegal additions, inform individual homeowner. My landlord is becoming hostile? 3 months ago my family and i moved into a rental house. we signed a 1 year lease and have paid our rent till dec 1 of this year. after the first month we were issued foreclosure papers on the rental. the landlord lied to us and hasnt been paying the mortgage so we contacted a bankruptcy trustee and he said that since hes filing bankruptcy we are not obligated to pay rent because he is relinquishing the house to the bank and he no longer owns the property plus we are just throwing our money away. so we stopped paying as of DEC 1 and now the landlord has written a ridiculous eviction stating we are to leave immediately. we know our rights and its illegal for him to force us out with out taking it to the courts first but the real issue is he claims starting tomorrow he is going to destroy the shed we have our stuff in and the very large deck attached to the house and along with what ever he pleases. we called the police and they said that they can do nothing because its a civil matter. i want to know if we have rights and can he destroy the home we are not officially evicted from. i live in Tampa Florida so the laws may be different in other areas. we are not sure who to call or what to do. im at the point of ready to fight this guy tooth and nail to ensure that my family isnt living in a destroyed home. we are only 6 days late on rent and hes becoming very hostile. what can i do..pleas help...

Can I file a lawsuit against bank? My husband purchased a property in Florida (only his name on note and deed). Bank filed a lawsuit (foreclosure) after we missed 3 payments. Bank foreclosed house right a way. Couple months later I found that I was a victim of mortgage fraud - defraud by bank Now I try to file a lawsuit against the bank (for fraud). Q: 1. Could they (bank) say - .You waived your right because you did not file a counterclaim against us when we foreclosed your house…. *It was a foreclosure lawsuit. I did not have any defense because I missed monthly payment. So I let them take my property. Now I am talking about fraud lawsuit. 2There was only my husband’s name in all the loan documents including a note and deed. Now; I want to be a plaintiff not my husband. Can they still argue about “collateral estoppel”?? 3 When bank filed a foreclosure lawsuit, was I in that lawsuit automatically even though I was not part of that mortgage transaction because I was his wife? 4 I am living in Virginia. Does foreclosure mean they can take other properties from you?? My mother-in-law owns 2 houses in southern Florida…the main one she lives in and the investment one she bought several towns over 2 years ago. The second one that she owns and had been renting out is now empty and she can no longer afford the payments. She has been to see her mortgage bank and they told her that it is only after she is 60 days late on payments they have to “do something about the situation.” We have been talking and talking for days now and she has decided that the only viable road left open to her is a Foreclosure. She has asked me for information about it and I do not know about Foreclosures. Does anyone know if her main house – the one she lives in and maintains a Homestead exemption on – can be taken from her if she Forecloses on the second one? Do I have to go to Court if I was subpoenaed and it is in another state? I live in Florida and I went to PA two years ago to my nephew's daughter's first birthday party. Anyway to make a long story short. They told me to park on the side of their house which is a side road. Anyway, I was leaving but wanted to pull my car in the driveway to get my kids into the car. As I was pulling out of the side street into the road in front of my nephew's house so I could pull into the driveway. This car came careening around the corner. The lady was speeding and it was proved. Now because I was 3 feet in my lane making a left.. she got startled or I really don't know what was going on in her car. Well she lost control of her car and went airborne into a tree. I thought I was a witness until I got two tickets in the mail when I went back home to florida. I couldn't go back to PA to fight the tickets so I just paid them. Crazy ...but I didn't have the money to go fight it. Now she is suing mef for 50,000, for her daughter. My insurance paid her money and the passenger...they wouldn't settle with the girl in the back seat. so they are going after me. My brother-in-law said I got railroaded because I didn't live there. Now I got to go to trial but my house is in foreclosure and my husband in a salesman but due to the ecomony he isn't selling much. We lost our cars and now I am trying to borrow money to save my house. How in the world can I go to pa if I don't even have a bank account or car to get there. Because I pleaded guilty to the tickets they found me 75% responible and her 25% responible for going to fast. My Car didn't even get hit or anything. What do you do about mentally abusive parents when you have no other choice? I ask this question because recently I've had to move back home because of financial reasons. One of the reasons is that I bought my parents house from them and let them live in the property as long as they payed the mortgage. Well come to find out they let the payments get so far behind that the bank is threatening foreclosure. This has forced me to leave my life in California to come back to Florida and straighten the mess out. Both are disabled and in the beginning I was waiting hand and foot on my mother who is recovering from double knee surgery. However I'm constantly being criticized about the smallest insignificant things by my over bearing father who has a major Napoleon complex and my mother is constantly on mood swing central. My deadbeat brother recently moved back in as well and has a child with a deadbeat mother who doesn't even have a high school diploma. When I do snap back in retaliation I'm told that I need to stay in a child's place. Im 34 years old by the way with no kids of my own. It as if they think that they are allowed to say what they want without consequence and then tries to use God as a weapon of defense against me. This household is total chaos and when I'm able I will leave and cut all ties with them. I know it may seem harsh but for my sanity I think Its right. On top of that they still think they are entitled to the sell of the house as well after I took out a mortgage in my name. Then my father will bring up how he paid my rent for a year while I was struggling as an actor and when it seemed as if my career wasn't going anywhere I hear every other day about what monies he sent to me. They didn't pay for my college education nor have I ever been in trouble with the law. Its scary to see how they've digressed into such a state. Am I wrong for my decision?

Husband foreclosing on his house and I'm buying a new one.? My husband bought a home before we got married. I am not on the loan or the deed. He is currently behind on payments and is thinking of letting it go into foreclosure. I am in the process of buying a house with my parents and have already been pre-approved, just waiting for my offer to get accepted. My concern is that when I try to get the loan, his foreclosure will somehow be linked to my name because we are married and live together. The broker said she has never seen this to be a problem but I am concerned because i am his spouse and we do file taxes together with that house's address. We live in Florida so I am not sure what the laws are here for that. Yea but someone said something about Florida being dower state and then they can attach a default judgment to the new property when we move in as a married couple??!?! Any Christian women gone thru this sour marriage experience? I'm 33 yrs. old, married for 7 yrs. and have a 6 yr.old girl. My husband and I are both Christian people, we believe in the Word of God and have been active in church. My world was turned upside down last Aug. after my husband admitted to me he called an escort off of the internet and had sex. He was concerned that he caught something and felt guilty and told me. We both got tested for HIV/STD all came back negative. The next day I took off w/ our daughter and moved in w/ my parents. He begged, cried, and asked for forgiveness for the next 3 months.after that. I was sooo angry,I even saw a divorce lawyer. He then stopped fighting, realized I didn't want to fix this marriage and he began to hang out w/ his brother and go to clubs and even began to talk to other women...younger than us...we are the same age. He then came back around, wanting to return, slowly I have been talking again to him and my daughter is extremely close w/ him...the separation has hurt her a bit. This breaks my heart. He wants us to start again and move back together. (We lost a house to foreclosure prior to that and were living w/ his in laws...that's why I took off!) He wants to get an apartment. I have very mixed feelings about this. As a Christian woman, were do I begin applying what the word of God says about forgiveness? That's my conflict. He says he's sorry but I don't trust him anymore! He put my life in danger...almost gave me a death sentence! Why Is It So Easy For Banks To Go To Court & Foreclose On Property Loans In The USA? A friend of mine is on the verge of losing his home for the sake of some $25,000 USD debt ( about five payments on his mortgage, he had a bad trading year last year, didnt everyone?) Can I sue the banks that gave out loans in my name without my permission or sighature? Someone stole my Identity and took out two loans in my name for 2 condos in Florida totaling $335,000.00. Now Citimortagage and IndyMac is coming after me for the money and they file foreclosures on my credit report. I submit and identity theft packet to both banks with Police report and samples of my signature. Now can I go after the banks in a law suite? If yes what grounds? and what kind of lawyer should i retain? The identity theft case is still under investigation. I had a fraud alert on my credit for 3 years before this and I think that the bank is negligent because they should have a rep at the closing to verify signature on the loan documents, and the damages that i suffer is a poor credit rating. This will be on my credit for a long time until they clear it up.

Today Rick Campbell, one of our senior members at age 87, is here to reminisce a bit and give us a history lesson. They rose to the occasion, even though they were controversial and widely hated while in office. Not such good years to be President. Just a few years prior, in 2008, the country began foundering. We were in the sixth year of the Iraqi Occupation, and the economy was flat. The mainstream press clearly wanted a Democrat elected. Although we didn't know it until some years later, oil producing nations had colluded to secretly buy their own oil on the open market, driving oil prices to shocking levels above the true demand price- reaching a high of $162 a barrel in October, 2008, just before the general elections. Their purpose was simple: to effect regime change in the United States. And of course, the U.S. economy was already in a real estate slump and also suffering the curse of stagflation; slow growth and high inflation. There were a million home foreclosures. Independent truckers went under by the thousands. Airlines failed. Airlines with names now long-forgotten: United, Delta, Northwestern, American. All now merged, of course, into the one lone U.S. carrier we love so much: Southwest. Against this backdrop of weariness of the war on terror, and economic distress, the American people were ripe for a demagogue, and they certainly got one in Barack Hussein Obama. He and his running mate Kathlene Sibelius inspired them with vague notions of hope and change; of a world in which diplomacy settled all international problems, of free universal health care, of abundant alternative energy, of peace and love. It was a vision too good to resist. The Republican nominee, a name you probably haven't heard in years anyone? Yes, it was John McCain, an obscure Senator from Arizona had no clue how to run a national campaign, and a platform nearly as liberal as Obama's. The selection of Condoleeza Rice as his running mate looked brilliant at first. Unfortunately, black voters viewed her as white, and women voters viewed her as one of the guys. Even so, the McCain/Rice ticket would have won the election if it weren't for the fact that 16 percent of conservative Republicans voted for anyone remember? That's right, Bob Barr, another name that's a footnote in history. After Obama's narrow win, thanks to recounts in Broward County, Florida, the country was positively giddy. A Democrat House, Senate, and President. At last an end to gridlock in Washington. Camelot! When Congress convened in January, 2009, the 44th President of the United States did something unique in history: he made good on his campaign promises. Certainly most Americans never really thought he was serious during the campaign. But whether because of inexperience, idealism, or simply incompetence, he followed through. In Obama's first One Hundred Days, the Congress passed his initiatives, and he signed them into law as he said he would. He repealed the Bush tax cuts, and increased capital gains taxes. He enacted a windfall profits tax, and instituted price controls on gasoline and diesel fuel. He passed universal health care, which added an additional 10 percent tax increase on all working Americans. He signed the Immigrant Amnesty bill which created 12 million new citizens instantly, each with entitlements. He closed the detention facility at Guantanamo Bay, and summarily released all the detainees. He repealed the Patriot Act, and cut funding for espionage, and eliminated all terrorist listening and wiretaps. Most important, he began the complete and immediate withdrawal of all American troops from Iraq. He ignored the advice of the Joint Chiefs of Staff, who wanted to retain bases in Kuwait and Qatar. Instead, he went with the recommendation of Secretary of Defense Dennis Kucinich, and ordered all troops back to U.S. soil. Viola! In One Hundred Days, by May of 2009, it was all done, and the vision was complete. He did exactly what he said he would do. And so it was in the summer of 2009 that things began to unravel for Obama. Of course, the economy needed a tax cut, not an increase, and unemployment quickly rose to 12 percent. Even attorneys and economists were put in the bread lines. Hard times! Price con! trols on gasoline immediately led to shortages and gas lines. The global cooling trend we have seen for the past 25 years first became obvious in 2009, exposing the CO2 global warming fraud. People were justifiably angry. Federal deficits increased massively because thousands of baby boomers, facing job loss and much higher taxes, simply gave up and took social security. Although the superb U.S. health care system was thrown into disarray, the bright spot was the creation of the Federal Department of Health care, and the immediate hiring of 250,000 administrators, inspectors and auditors, the only job growth in any economic sector in 2009. By February 2010, the U.S. military withdrawal from Iraq was complete. It was a very expensive undertaking. And then in March, the gradual Shiite insurgencies from Iran turned into a true Iraqi civil war. In May, Iranian tanks crossed the border and quickly took Baghdad. Although the exact number is not know, at least 230,000 Sunni Iraqis died as we stood by. Iran also quickly moved into undefended Kuwait. President Obama did exactly what he said he would. He sent Secretary of State, Maria Cantwell, to Tehran to meet with Iranian President Ahmadinejad. After two weeks of high level talks, the United States agreed to allow Iran to retain Iraq and Kuwait to create stability in the middle east, with the understanding that Israel would not be disturbed. Cantwell returned to Washington, and explained the agreement in her famous speech, in which she proudly noted that the Obama administration had finally achieved "peace in our time" in the Middle East. So there was some surprise at the rocket attacks on Tel Aviv on August 14th. President Obama said, "This is not the Mahmoud Ahmadinejad I knew." The Obama administration decided it would be de-stabilizing to take sides in the conflict, and approximately 29,000 Israeli civilians died during the summer and fall. American Jews were appalled at the inaction. Yes, in 2010 most American Jews were Democrats, but because of 2010, they are solid Republicans today. As awkward as it was, everything might have turned out all right for the Obama administration going into the fall mid-term elections of 2010, if it hadn't been for the dirty bomb in the Port of Long Beach. The administration had cut funding for the inspection of containers, because they felt it showed a "lack of trust" in the international trading community. It wasn't really a very big bomb, and thank goodness, not a real nuclear device, but nonetheless it contaminated some expensive real estate-Newport Beach, Palos Verdes Estates- and ultimately caused the death of 14,000 Americans. People were especially annoyed that Disneyland had to be closed for decontamination. And so, in the midterm elections, Republicans regained control of both the House and Senate, and the rest is history. The impeachment proceedings against President Obama for "failure to protect and defend" were swift and nearly unanimous. Vice President&nbs! p;Sibeli us resigned. Newly-elected Speaker of the House, J.C. Watts, became the 45th President of the United States. But you know the rest of the story well. Republicans finished the war on Islamic fundamentalists, largely by aiming ICBM's at Mecca and Medina. No Democrat has been elected President since. Republicans have held both Houses of Congress. History of Western Civilization and Economics are now taught in all public schools, and in English only. Marriage is defined as one man and one woman. And there are border fences, north and south. We old codgers remember the ancient Confucian curse: "May you live in interesting times." Well, 2010 was an interesting year, but it was not a good year to be president." (Far fetched? Does foreclosure mean they can take other properties from you?? My mother-in-law owns 2 houses in southern Florida…the main one she lives in and the investment one she bought several towns over 2 years ago. The second one that she owns and had been renting out is now empty and she can no longer afford the payments. She has been to see her mortgage bank and they told her that it is only after she is 60 days late on payments they have to “do something about the situation.” We have been talking and talking for days now and she has decided that the only viable road left open to her is a Foreclosure. She has asked me for information about it and I do not know about Foreclosures. Does anyone know if her main house – the one she lives in and maintains a Homestead exemption on – can be taken from her if she Forecloses on the second one? How can I sue someone living outside the U.S. that bought my business in Florida? I have a Ballon Short Term Promissory Note valued @ 42K and a 160K Note/monthly payments of 5k plus with a person living in France that bought my business in Florida, U.S. Currently, the buyer is 30 days past due, as of June 1, 2008 and refuse to acknowledge payment(s) or pay balance owed. The buyer has appointed her brother as power of attorney who is currently running the business, is listed as corp. pres. and living in Florida. The brother, also the broker, knowingly and willfully breached the contract agreement, thereby, causing default of payment and forcing me to seek legal action. It very difficult for me to find an attorney willing to sue a person overseas (France) and; as a single mother of three children, my funds are limited and home is in foreclosure due to the loss of income provide by the buyer. I have a Security Agreement on the assets in the business, however, I released all my corp. shares to the buyer, and in good-faith I would be paid. There is no evidence, at this time, which the buyer knows what her brother is doing; however, the brother is doing everything he can to discredit me (going as far as accusing me of stealing from him (?), untrue). My Security Agreement and Default Agreement states that if the buyer goes in default all assets can be seized or sold to satisfy the loan (money owed to me). How can I sue the buyer or the brother acting as power of attorney without appearing in France? How can I sue the buyer in the U.S and demand for her to come to the Florida to settle? And, how can I file a judgment to seize the assets (the fastest way for results) if the buyer lives in France? Please keep in mind, the buyer’s cooperation (I sold her) is located in the U.S. (i.e. Florida) and all documents, closing, purchasing agreements and transfer of shares were executed in Orlando, Florida, U.S. Therefore, I don’t understand why the buyer is allowed to breach/default our agreement and disregard the U.S. laws that protect our right(s) for due process simply by geography.
